Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Loudega ("Company," "we," "us," or "our") governing your access to and use of our website, mobile applications, retail locations, and related services (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.
Eligibility
To use our Services, you must:

Use of Services
Retail Locations
Our unattended retail locations (including smart vending machines, micro-markets, and other automated retail solutions) are available for use subject to location-specific rules and hours of operation. By using our retail locations, you agree to:
- Follow all posted instructions and signage
- Use equipment properly and not attempt to tamper with or damage machines
- Complete payment for all products before removing them from the retail location
- Report any malfunctions or issues to us promptly
Account Registration
Some features of our Services may require you to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring your account information remains accurate and up-to-date
Purchases and Payments
Pricing
All prices are displayed at the point of sale and include applicable taxes unless otherwise noted. Prices are subject to change without notice. We strive to ensure pricing accuracy, but errors may occasionally occur. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price.
Payment Methods
We accept various payment methods including credit cards, debit cards, and mobile payment options at our retail locations. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge your payment method for all purchases made.
All Sales Final
Due to the nature of our automated retail services, all sales are final. However, if you experience an issue with a purchase (such as a machine malfunction or product quality concern), please contact us at hello@loudega.com and we will work to resolve the issue.
Prohibited Conduct
When using our Services, you agree not to:
- Violate any applicable laws, regulations, or third-party rights
- Engage in fraudulent activities or use stolen payment methods
- Tamper with, damage, or attempt to bypass security features of our equipment
- Remove products without completing payment
- Use our Services for any illegal or unauthorized purpose
- Interfere with or disrupt the operation of our Services or equipment
- Attempt to access restricted areas or systems
- Harass, threaten, or harm other users or our staff
Intellectual Property
All content, features, and functionality of our Services—including but not limited to text, graphics, logos, icons, images, software, and the overall design and arrangement—are owned by Loudega or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any of our content without our prior written consent.
Product Information
We strive to provide accurate product descriptions, nutritional information, and allergen warnings. However:
- Product packaging and labels contain the most accurate and up-to-date information
- We are not responsible for manufacturer changes to products or packaging
- You are responsible for reviewing product labels for allergen and nutritional information
- If you have food allergies or dietary restrictions, please check product labels carefully before consuming
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOUDEGA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.
Our total liability for any claim arising from your use of our Services shall not exceed the amount you paid to us for the specific product or service giving rise to the claim.
Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Indemnification
You agree to indemnify, defend, and hold harmless Loudega and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your use of our Services, or your violation of any rights of another party.
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or our Services shall be resolved exclusively in the state or federal courts located in Jefferson County, Kentucky.
You agree to submit to the personal jurisdiction of such courts and waive any objection to venue in such courts.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this page. Severability
